The intent of this contract is first – for the protection of the puppy/dog and second – for reasonable recourse/coverage for the buyer and Breeder/Seller. 

The Seller/Breeder requires a Spay or Neuter.
____ Buyer understands and agrees that the Dog shall be used solely as a companion pet and shall not be used for breeding.

As a breeder, I carry a great deal of responsibility for the breed’s development, and buyers agreeing to spay/neuter pet puppies is part of that responsibility. Although the age to spay or neuter is a discussion with your vet, recent research indicates that waiting longer to spay/neuter benefits the dog’s health when postponed to 18 mos.


1)  Initial Health Assessment – Seller provides that the above puppy/dog is in good physical and mental condition and free from any contagious disease when the buyer takes possession of the dog.

_____ Within 72 hours of the puppy transfer, the Buyer agrees to have a licensed veterinarian perform an Initial Health Assessment of the Puppy at the Buyer’s sole cost.

Other than diarrhea (Giardia, Coccidia, etc.) resulting from a change in diet, environment, or travel stress, the licensed veterinarian determines that the Puppy suffers from a life-threatening condition within 72 hours, the Buyer must notify the Seller and provide the Seller receipt of the veterinarian’s statement regarding the puppy’s health supported by the relevant lab report and only on this initial exam.

The Buyer may elect to keep the puppy and assume all costs for its care, or the buyer has the right to return the animal for a full refund of the purchase price (less deposit) provided they have given the seller adequate documentation from a licensed veterinarian and that the animal has sustained no injury after the buyer took possession.

Failure to comply with this provision voids any health guarantee provided under this Agreement or otherwise.
Neither Kasey Mando nor Lenny Schudar is responsible for any costs incurred by your puppy at your veterinarian. All veterinary treatment authorized without the Seller’s consent will be at the Buyer’s expense. This is to protect the Buyer as well as the Seller.

*Seller intends that the Buyer will be 100% satisfied with their purchase and understand that when dealing with live animals, some things are beyond human control.

2)  GeneticsThe Puppy/Dog is guaranteed to be free of clinical symptoms of hip dysplasia, elbow dysplasia, patellar luxation, and inherited epilepsy until 30 months. Verifying any of these diseases will require evaluation by a veterinarian by OFA protocols, including an OFA rating of dysplastic in the case of hip or elbow dysplasia.

_______Buyer is responsible for limiting the puppy to age-appropriate exercise to prevent injury as the puppy matures.

NOTE:  Many joint issues can be avoided by proper feeding and care.

In the rare case of a severe genetic defect affecting the dog’s quality of life as a family pet, the Buyer may choose to return the dog to the Seller for a suitable replacement of at least equal or better quality and breeding. Buyer may be compensated a percentage of the original cost of the pup, understanding that returning the dog is not a requirement. Puppy can stay in the home if the dog is loved and in a permanent, forever home.

Epilepsy can be caused by outside chemical reactions such as ingestion of antifreeze or Ivermectin. These accidental issues are NOT the responsibility of the Breeder. Inherited defects ARE. Aging difficulties are not Breeder’s responsibility unless said condition occurs unusually early, as documented by a veterinarian.

 3) Temperament – Your puppy requires ongoing effort to socialize your pup. The seller guarantees temperament, but with the exception that the buyer will properly socialize and expose the puppy to various situations to help develop a sound temperament.  The first 12 weeks are critical, and the first two years are crucial.

NOTE: Contact me should concerns arise with temperament, and I will provide ideas and training solutions.

Miniature American Shepherds are naturally active herding dogs. Although we do not guarantee its fitness for particular tasks, your puppy will likely be busy or want a job. The bond you develop in learning/training with your puppy is priceless and helps to provide you with an even more wonderful companion in your home. Herding breeds can excel in agility, herding, barn hunt, nose work, obedience, rally, tricks, and therapy work.

To encourage activity with your puppy, AKC Canine Good Citizen is a title that can be earned and the benefits enjoyed by both the puppy and you, the puppy’s new owner.

___The Buyer is expected to enroll in and attend basic obedience classes or other training venues to socialize the pup in multiple situations. (“Multiple situations” expects and requires more than around your home/family/property).

4)  Guarantees: We guarantee that said puppy is free of hereditary defects to the best of our knowledge. Before any genetic health guarantees are honored, the Buyer must provide the Seller with a signed veterinarian’s statement stating the health condition, the inherited genetic origin of the health condition, and the prescribed treatment. The Seller reserves the right to have a second opinion by a different veterinarian of choice to evaluate the dog’s disease/condition within one month, at the Seller’s expense, before the guarantee will be honored. In the rare instance that, In the above cases and a puppy is returned, the purchase price, less the admin fees, and deposit may be refunded.

5)   Seller may predict, but cannot guarantee, the adult size of this puppy/dog.

6) The Buyer agrees that the Puppy/dog will be an integral part of their family unit, housed indoors as a companion, and to take proper safeguard care to ensure the dog’s emotional well-being.

The Buyer will provide food, water, medical care, socialization, training, and exercise appropriate to the age and condition of the Dog. The Dog will not be left unattended on a chain, rope, or tie-out device. The Dog will not be allowed to run at large and will be kept under leash or voice control at all times when not within a fenced area.

There is no reason that any Ultra Quest or Trifecta puppy should ever be surrendered to a shelter or rescue situation. We care about our pups. However, if at any time in the life of the dog, it is found incompatible with the situation of the Buyer and the Buyer is unable to care for or keep this dog, the Buyer agrees to contact the Seller so arrangements may be made to find a suitable home for the placement of this dog or the dogs return to the seller/breeder. When the dog is returned to the seller, the buyer will provide the dog’s registration certificate and signed transfer back to the seller. No refunds will be given.

There will be no charge for board or care until the dog is re-homed, but the Buyer is responsible for getting the dog to the Seller. If the Buyer finds a new home for the dog, the Buyer agrees to provide the Seller with the new owner’s name, address, and phone number.
